We believe that the act of giving freely, without the expectation of something in return, is a powerful way to build connections and foster a sense of community.

Non-commercialization: We are committed to promoting the communal and experiential aspects of arts and venues, and reject the commercialization of these art forms.

Self-sufficiency: We believe that each person is responsible for their own growth and progress, and that we should strive to be self-sufficient and self-reliant. We encourage individuals to take ownership of their own learning and development within their communities.

Self-expression: We value the unique voices and styles of all artists and venues. We believe that each person has something unique and valuable to contribute, and that it is essential to create a space where everyone feels free to express themselves.

The following Legal Disclaimer (the "Disclaimer") outlines the terms and conditions governing the use of the "87 Foundation" group platform and any associated services (hereinafter referred to as the "Platform"). By accessing or using the Platform, you (hereinafter referred to as "User") agree to be bound by this Disclaimer. If you do not agree with any part of this Disclaimer, you must refrain from using the Platform.

1. No Legal Advice
The content and information provided on the Platform are for general informational purposes only and should not be construed as legal, financial, or professional advice. The Foundation is not a law firm, financial institution, or professional advisory service, and no attorney-client or professional-client relationship is created by accessing or using the Platform.

2. Accuracy of Information

Liability Waiver

Liability Waiver and Release Agreement

IMPORTANT: READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.

This Liability Waiver and Release Agreement (the "Agreement") is made effective as of [Today’s Date], by and between 87 Foundation, a nonprofit organization located at 1962 Market St., Denver CO 80204 (hereinafter referred to as "Entertainment Venue"), and the undersigned individual (hereinafter referred to as "Member").

1. Membership Agreement:
By signing this Agreement, the Member acknowledges and agrees to become a member of 87 Foundation and agrees to abide by all rules, policies, and procedures established by the Entertainment Venue.

2. Assumption of Risks:
The Member acknowledges that participating in activities or events at 87 Foundation, whether indoors or outdoors, may involve certain risks, including but not limited to injury, property damage, or loss. These risks may arise from the actions or omissions of the Member or others, the condition of the premises, or the use of equipment, facilities, or services provided by 87 Foundation.

3. Release of Liability:
In consideration of being allowed to participate in activities at 87 Foundation, the Member, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby fully and forever releases, discharges, and holds harmless 87 Foundation, its directors, officers, employees, volunteers, agents, and representatives, from any and all claims, demands, liabilities, actions, suits, or causes of action, whether at law or equity, for personal injury, property damage, or any other loss, including death, arising out of or in connection with the Member's participation at 87 Foundation.

4. Maximum Liability of 87 Foundation:
If, notwithstanding the release of liability set forth in this Agreement, 87 Foundation is found to be liable for any loss or damage, the Member agrees that the maximum liability of 87 Foundation shall not exceed the membership fees paid by the Member for the current membership term.

5. Rights of Minors:
If the Member is a parent or legal guardian of a minor (under 18 years of age), the Member agrees to assume all risks and responsibilities on behalf of the minor and to bind the minor to the terms of this Agreement. The Member further represents and warrants that they have the legal authority to enter into this Agreement on behalf of the minor.

6. Indemnity:
The Member agrees to indemnify, defend, and hold harmless 87 Foundation, its directors, officers, employees, volunteers, agents, and representatives from and against any and all claims, demands, liabilities, actions, suits, or causes of action, whether at law or equity, arising out of or in connection with the Member's actions, omissions, or participation at 87 Foundation. This indemnity includes, but is not limited to, any claims for personal injury, property damage, or any other loss, including death, caused by the Member's negligence, recklessness, or willful misconduct.

7. Opting Out of the Waiver:
If a Member wishes to opt-out of this waiver for a specific event or activity, they must submit a written request to 87 Foundation at least 14 days prior to the event or activity in question. 87 Foundation reserves the right to deny any opt-out requests at its sole discretion.

8. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of laws principles.

Terms and Conditions

Terms and Conditions for Members

1. Membership Eligibility:
1.1. Membership with 87 Foundation is open to individuals who meet the eligibility requirements set forth by the Entertainment Venue.
1.2. Members must be at least [minimum age] years old to join. If the Member is a minor (under 18 years of age), a parent or legal guardian must sign this agreement on their behalf.

2. Membership Benefits:
2.1. By becoming a member of 87 Foundation, individuals gain access to exclusive events, activities, and facilities organized or hosted by the Entertainment Venue.
2.2. Membership benefits are subject to change, and the Entertainment Venue reserves the right to modify or discontinue benefits at any time.

3. Membership Fees:
3.1. Members are required to pay the applicable membership fees as determined by 87 Foundation. Membership fees may be subject to periodic updates, and members will be notified in advance of any changes.
3.2. Membership fees are non-refundable, except as required by law.

4. Membership Duration:
4.1. Membership with 87 Foundation is valid for the duration specified in the membership agreement.
4.2. The membership term may be renewed upon payment of the applicable renewal fees.

5. Code of Conduct:
5.1. Members must adhere to the code of conduct set forth by 87 Foundation. This includes respecting the rights and safety of other members and staff, as well as abiding by all rules, policies, and procedures established by the Entertainment Venue.
5.2. Any breach of the code of conduct may result in membership suspension or termination at the discretion of 87 Foundation.

6. Liability Waiver:
6.1. By becoming a member of 87 Foundation, the Member agrees to be bound by the terms of the Liability Waiver and Release Agreement, which outlines the Member's assumption of risks and release of liability for participating in activities at the Entertainment Venue.
6.2. The Liability Waiver and Release Agreement is an integral part of the membership agreement and must be signed by all members.

7. Indemnity:
7.1. Members agree to indemnify and hold harmless 87 Foundation, its directors, officers, employees, volunteers, agents, and representatives from and against any claims, demands, liabilities, actions, suits, or causes of action arising out of or in connection with the Member's participation at 87 Foundation, as outlined in the Liability Waiver and Release Agreement.

8. Intellectual Property:
8.1. Members shall not use the name, logo, or any trademarks of 87 Foundation for any commercial or promotional purposes without prior written consent from the Entertainment Venue.

9. Termination of Membership:
9.1. Membership with 87 Foundation may be terminated by the Member or the Entertainment Venue at any time, with or without cause, upon written notice to the other party.
9.2. Upon termination, the Member's access to membership benefits will cease, and any outstanding membership fees shall remain non-refundable.

10. Amendments to Terms and Conditions:
10.1. 87 Foundation reserves the right to amend these Terms and Conditions at its sole discretion.
10.2. Members will be notified of any changes to the Terms and Conditions in advance, and continued membership will constitute acceptance of the revised terms.

11. Governing Law:
11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of laws principles.

Refund Policy

Refund Policy

1. Donations and Nonrefundable Fees:
1.1. All tickets purchased and membership fees will be paid to Warm Cookies of the Revolution, the fiduciary sponsor of th 87 Foundation 
1.2 All funds offered are considered donations to support the nonprofit mission of the 87, the venue that 87 Foundation operates.
1.3. As such, all donations, including ticket purchases and membership fees, are nonrefundable. 87 Foundation does not provide refunds for tickets or membership fees under any circumstances.

2. Tax Receipts:
2.1. Patrons who make donations through ticket purchases or membership fees may be eligible to receive in-kind tax receipts for their contributions.
2.2. To request an in-kind tax receipt, patrons must provide their contact information, including their full name and email address, and submit a request to [email address for tax receipt requests].
2.3. 87 Foundation will process tax receipt requests within a reasonable timeframe and in accordance with applicable tax laws and regulations.

3. Event Cancellations or Rescheduling:
3.1. In the event of an unexpected cancellation or rescheduling of an event hosted by 87 Foundation, the Entertainment Venue may, at its sole discretion, offer alternative arrangements or credits for future events.
3.2. If a patron is unable to attend a rescheduled event, no refunds will be provided, as the original ticket purchase is considered a donation.

4. Errors or Technical Issues:
4.1. In the event of technical issues or errors related to online ticket purchases or membership fee payments, patrons are encouraged to contact 87 Foundation at [customer support email/phone number] for assistance.
4.2. If an error occurs during the transaction process, 87 Foundation will make reasonable efforts to resolve the issue; however, no refunds will be issued unless there is clear evidence of a double payment or other verifiable errors.

5. Exceptions:
5.1. In exceptional circumstances, 87 Foundation may consider refund requests at its sole discretion. Such requests must be submitted in writing to [refund request email address] and will be reviewed on a case-by-case basis.
5.2. Any refunds granted will be subject to administrative fees and transaction costs incurred by 87 Foundation.

6. Amendments to Refund Policy:
6.1. 87 Foundation reserves the right to amend this Refund Policy at any time. Any changes will be effective upon posting the revised policy on the Entertainment Venue's website.
6.2. Patrons will be bound by the most current version of the Refund Policy for all donations made after the effective date of any changes.
